Kndly, Inc. ("us", "we", or "our") operates http://petswapp.com (the "Website").

This privacy policy (“Privacy Policy”) describes our practices in connection with information we collect through our websites (“Websites”), social media pages we control (“Social Media Pages”), and software applications we make available for use on or through computers and mobile devices (“Apps”), that include a link to this Privacy Policy, and through any of our offline activities, such as when you provide your information on the phone via our call centers or in person (“Offline Activities”) (collectively, including the Websites, Apps, Social Media Pages, and Offline Activities, the “Services”).

You don’t need to register for a PetSwapp account in order to visit or use some features of our Services. However, certain Services require that you register for an account.

WHAT INFORMATION WE COLLECT

  • We may collect “Personal Information” (information that identifies you or relates to you as an identifiable person) about you, which you voluntarily give to us either upon sign-up or such as your:
    • First and Last Name
    • Birthday
    • Postal address (including billing and other property addresses)
    • Phone number
    • Email address
    • Credit or debit card number
    • Financial information
    • Social media account information
    • Special needs or conditions that may impact your swap
    • Swap, product, service or related information, such as your preferred location/facilities, dates and number of pets swapping
    • Driver’s license, government-issued ID, or passports
    • Geolocation information
    • Communication, product, service or other preferences
    • Demographic information
    • Photos or videos uploaded
    • Time Zone
    • IP address or Device ID
    • Subscribing membership ID
  • Facebook Permissions The App may - if you choose to sign in with Facebook - access your ​Facebook basic account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. We may also request access to other permissions related to your account, such as friends, check-ins, and likes, and you may choose to grant or deny us access to each individual permission.   • Google Permissions The App may - if you choose to sign in with Google - access your Google basic account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. We may also request access to other permissions related to your account, and you may choose to grant or deny us access to each individual permission.
  • Derivative Data and Uploaded Media Information our servers automatically collect when you access the App, such as your native actions that are integral to the App, actions taken when creating entries, editing entries and uploading media to the App. As such, we may also request access to your device’s photo roll or camera in order for us to upload your media to the App. Any media uploaded in this fashion, will be collected and stored on our servers. If you wish to change our access or permissions, you may do so in your device’s settings.
  • Push Notifications We may request to send you push notifications regarding your account or the App. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.
  • Geo-Location Information We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the App, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.
  • Mobile Device Access We may request access or permission to certain features from your mobile device, including your mobile device’s reminders, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.
  • Mobile Device Data Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide.

WHY AND HOW WE USE YOUR INFORMATION

We may Process Personal Information in connection with any of the following:
  • Our business transactions with you, including, but not limited to:
    • Entering into or performing a contract with you.
    • Responding to your enquiries and fulfilling your requests.

  • We may also share your information to our preferred service providers: Organizations that have agreed to offer our members preferential rates and offers, so that they may verify your eligibility for these offers and communicate them to you. We may also share your information with selected third parties so that they may offer you their products and services.
  • User Profiles and Submissions: Certain user profile information, including your name, location, and any video or image content that you upload to the Services may be displayed publicly or to other users. Please remember that any content you upload to your public user profile, along with any information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.), becomes publicly available, and can be collected and used by anyone. Your username and communications may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments. We may make reviews, message boards, blogs, and other such user-generated content facilities available to users. Any information disclosed in these areas becomes public information and you should always be careful when deciding to disclose your Personal Information. Again, we do not control the policies and practices of any other third-party site or service with regard to your data. 
  • Business Transfers: Petswapp may sell, transfer or otherwise share some or all of its assets, including Personal Information, in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction, or in the event of insolvency or bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity’s planned processing of your information differs materially from that set forth in this Privacy Policy.
  • Disclosure Permitted by Law: We may disclose your Personal Information to law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information, if required or permitted to do so by law or legal process, to respond to claims, or to protect our rights, interests, privacy, property or safety, and/or that of our Affiliates, you or other third parties.

We may share your Personal Information (subject to your Right to Opt-Out of those sales) with these third parties, but only to the extent necessary to perform these functions and provide such services. These third parties are carefully selected to ensure that they and their related entities, who may access your information, provide your information with equal protection to that stated on this privacy policy, and required by applicable privacy laws and the Platform Provider rules, policies and guidelines. The CCPA prohibits third parties who purchase the Personal Information we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Third-party content may use cookies, web beacons, or other mechanisms for obtaining data in connection with your viewing of the third-party content on the Service. Additionally, we may implement third party buttons, such as Facebook “share” buttons, that may function as web beacons even when you do not interact with the button. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Please note that if you delete, or choose not to accept, cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.

DO NOT TRACK

Petswapp does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who use our Service.

CHANGES TO OUR PRIVACY POLICY:

From time to time we may revise this Privacy Policy and/or use Personal Information for new, unanticipated uses not previously disclosed to meet changes in the regulatory or business environment, or to satisfy the needs of our customers and service providers. Updated and date stamped versions will be posted on the Services. Unless otherwise required under applicable law (e.g. obtaining consent from you for the relevant material changes) the revised Privacy Policy will take effect immediately upon such posting.
